1. Who we are and what this covers
"Coloroid AI", "we", "us" and "our" refer to the developer of the Coloroid AI application for iPhone and iPad. "You" refers to the person using the app. "Service" means the app together with the servers and third-party processors it uses to restore, colorize and descratch photographs.
These Terms apply alongside our Privacy Policy, which explains what happens to your photos and personal data.
2. Licence and the Apple Standard EULA
We grant you a personal, non-transferable, non-exclusive and revocable licence to use the app on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules.
The app is also licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"), which is available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Standard EULA cover the same subject and cannot be read together, the Standard EULA prevails.
You may not copy, modify, reverse-engineer, decompile, rent, resell or redistribute the app or any part of it, except to the extent that applicable law expressly permits it.
3. Your photos and your rights in them
You keep every right you already had in the photographs you upload, and you own the restored results the Service returns to you. You may use them however you like, including commercially — printing, sharing, publishing or selling them.
You give us only the permission we need to run the Service: a limited licence to transmit, process and temporarily store the photo you submit for as long as it takes to produce your result. We do not use your photos to train AI models, and we do not publish them or share them with anyone other than the processors described in the Privacy Policy.
You confirm that you own the photographs you upload, or that you otherwise have the right to have them processed, including any permission needed from the people who appear in them.
4. Acceptable use
You agree not to use the Service to upload or produce:
- images you have no right to use, including images that infringe someone else's copyright or other rights;
- sexual content involving minors, or any other material that is illegal where you are;
- images of other people used to harass, defame, impersonate or deceive, or to create misleading depictions of real individuals or events;
- content intended to be passed off as an authentic record of something that did not happen.
You also agree not to interfere with the Service — no scraping, no automated bulk submission, no attempt to bypass usage limits, and no reverse-engineering of the API the app uses.
We may suspend or end your access to the Service if you break these rules.
5. AI results
Restoration and colorization are produced by generative AI models. They reconstruct detail that is damaged or missing, which means the result is an interpretation, not a recovery of the original: colours, textures and fine details may be plausible rather than historically accurate.
Results vary with the condition, resolution and content of the photo you submit. We do not guarantee that any particular photo can be restored, that any particular result will be produced, or that results will be suitable for evidentiary, forensic, archival or identification purposes.
The app never alters the original photo in your library — results are saved as new images.
6. Subscriptions, billing and cancellation
Some features require a paid subscription. Subscriptions are offered as auto-renewing plans, and the price, billing period and any introductory or trial offer are shown in the app before you confirm the purchase.
- Payment is charged to your Apple ID account when you confirm the purchase. All purchases are processed by Apple; we never see or handle your payment details.
- Renewal is automatic. Your subscription renews at the end of each period unless auto-renew is turned off at least 24 hours before the period ends, and your account is charged for renewal within 24 hours of the end of the current period.
- Managing and cancelling is done in your Apple ID account settings on your device — Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
- Free trials, where offered, forfeit any unused portion when you buy a subscription, if applicable.
- Refunds are handled by Apple under the App Store's terms; we cannot issue them ourselves. Requests can be made at reportaproblem.apple.com.
Prices may change. We will tell you before a change takes effect, and a price increase does not apply to your current period.
7. Our intellectual property
The app, its name, logo, interface, code and all related materials belong to us or our licensors and are protected by copyright and other laws. Nothing in these Terms transfers any of those rights to you.
8. Third-party services
The Service depends on third parties — including Apple for distribution and billing, and OpenAI for image processing — and their availability is outside our control. Their handling of data is described in our Privacy Policy and governed by their own terms.
9. Availability
We aim to keep the Service running, but we do not promise that it will be uninterrupted or error-free. We may change, suspend or discontinue features, and we may impose usage limits to keep the Service working for everyone.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any rights you have as a consumer under the law of your country that cannot be waived.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or photographs, arising out of your use of the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim arose.
Keep your own copies of photographs that matter to you. The Service is not a backup service and does not store your images.
12. Apple
Apple is not a party to these Terms and has no responsibility for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any claim that the app fails to conform to an applicable warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no other warranty obligation.
13. Termination
You may stop using the Service at any time by deleting the app — remembering to cancel any subscription separately, as described in section 6. We may suspend or terminate your access if you breach these Terms or if we are required to by law. Sections that by their nature should survive termination — including sections 3, 7, 10, 11 and 12 — continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. The updated version is posted on this page with a new "Last updated" date, and it takes effect when posted. Continuing to use the Service after that means you accept the change.
15. Governing law
These Terms are governed by the laws applicable at our place of business, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer law in your country of residence.
